Participants in the Brazos Education Lending Corporation (“Brazos”) Referral Program (“Program”) are subject to Brazos’ Terms of Use and Website Privacy & Security Policy (both available on our website studentloans.com), as well as these additional “Referral Program Terms and Conditions”. By participating in the Program, each participant agrees that he/she has read and agrees to be bound by the Terms of Use, Website Privacy & Security Policy, and these Referral Program Terms and Conditions.

PROGRAM ELIGIBILITY
The Program extends bonuses as described below for referrals of Brazos’ Texas Student Loans, Parent Loans, and Refinancing Loans (“Eligible Loans”).  Both the Referrer and the Referred Borrower, as defined below, must be a resident of Texas to participate in the Program. The Program is limited to referrals of friends, family members, and direct acquaintances (together referred to as “Friends”) and who the Referrer believes may be interested in applying for an Eligible Loan.

You are not required to have a loan or account with Brazos in order to be eligible to refer Friends to Brazos under the Program. The Program is only open to individuals who are a U.S. citizen, a permanent resident, or a resident alien with a valid U.S. Social Security Number residing in the United States and who are residents of the State of Texas. Participants also must be the age of majority in the state of Texas to participate.

Referrers will not receive credit for referring themselves, including for a refinance of their existing Brazos loans, or submitting an application via their own unique referral link.

Employees of qualified educational institutions, such as school financial aid officers, are not eligible to participate in the Program.

THE CASH REWARDS
Brazos will pay a bonus to Referrers of Eligible Loans (“Referral Bonus”) and another bonus to the eligible borrower that was referred (“Referred Borrower”) and who took out the Eligible Loan (“Welcome Bonus”)(the “Referral Bonus” and “Welcome Bonus” may be referred to, together, as the “Cash Reward(s)”). The Program supports referrals for Eligible Loans only, and no payments will be made for referrals to any other loans or products or for any other reason.

The Cash Rewards will be in an amount as advertised at the time the Referrer signs up and accepts the  Unique Referral Link to participate in the Program. The amount of the Cash Rewards may vary depending on loan products. Brazos may, in its sole discretion and after reasonable notice to the Referrer to the contact information provided, modify the amount of either Cash Reward.  The Referral Bonus and the Welcome Bonus will be paid after the first disbursement on an Eligible Loan that is not canceled within the applicable cancellation period as per the terms of the loan program.

To receive credit for a referral under the Program, eligible Referrers must complete the provided form including their full name, a physical address and an email address.    Upon completion of the form, the Referrer will be provided a unique referral link (“Unique Referral Link”) which can be shared with Friends whom the Referrer believes will be interested in the Program. In order for the Referrer and the Referred Borrower to receive credit, each Referred Borrower must use the Unique Referral Link to visit the studentloans.com website, click “Apply Here” to apply for a loan, complete their application, become approved, and proceed all the way through the first disbursement of the Eligible Loan. Bonuses will only be awarded after the first disbursement of the Eligible Loan is made and any applicable loan cancellation period has elapsed.  Bonuses are not eligible if the borrower arrives through one of Brazos’ third-party lead-generation websites or business partner’s links or landing pages.

There will be only one payment to a Referrer and Referred Borrower per Unique Referral Link.   If two or more individuals refer the same friend, then referral credit will be given to the Referrer based on the Unique Referral Link used to apply for the loan through Brazos’ website or, if a Referred Borrower applies for multiple loans, the first one to disburse.

Although only one Referral Bonus and Welcome Bonus will be paid per Referred Borrower, Referrers may earn more than one Referral Bonus by referring multiple Friends. A Referrer and Referred Borrower will not earn a bonus if the Referred Borrower does not use the Referrer’s Unique Referral Link when applying for their Eligible Loan.  Brazos will not provide the Referrer information on  the status of an application for  Referred Borrower, anyone referred, whether or not they applied, or the names of the Referred Borrowers for whom a Referral Bonus is being paid.   Regardless, as a result of participation in the Program, the Referrer and/or the Referred Borrower may become aware of a relationship with Brazos. As such, Referrers and Referred Borrowers’ participating in the program, by agreeing to participate, grant a one-time limited waiver of privacy rights related thereto.  All Referral Bonuses and Welcome Bonuses will be paid via check as set forth below and in accordance with Brazos’ standard accounts payable.

PAYMENT TERMS
For the Referrer, once a Referral Bonus is due under the Program, Brazos will mail a check to the address provided at the time the Referrer signed up for the Program or as updated as indicated below.  Referrers who do not cash the check for their Referral Bonus within ninety (90) days of issuance are deemed to have forfeited their Referral Bonus.  Once issued and mailed, checks will not be re-issued.   Referrers are responsible for keeping Brazos apprised of any physical address or email  address change by contacting Brazos at customerrelations@brazos.us.com.

For the Referred Borrower, once a Welcome Bonus is due under the Program, Brazos will mail a check to the permanent address provided on the loan application or as updated as indicated below.  Referred Borrowers who do not cash the check for their Welcome Bonus within ninety (90) days of issuance are deemed to have forfeited their Welcome Bonus.  Once issued and mailed, checks will not be re-issued.   Referred Borrowers are responsible for keeping Brazos apprised of any physical address or email  address change by contacting Brazos at customerrelations@brazos.us.com.

All federal, state and local taxes and duties are the sole responsibility of the Referrer and Referred Borrower. Payments may not be transferred. Any bonus due that would cause the cumulative bonuses paid to a Referrer in any calendar year to exceed $599 may not be paid unless the Referrer completes and returns to Brazos a United States, Department of Treasury, Internal Revenue Service Form W-9 (see https://www.irs.gov/pub/irs-pdf/fw9.pdf). A 1099 will be issued to a Referrer if the cumulative bonuses paid exceed $599 in any calendar year.

REFERRAL RULES/NO SOLICITATION/NO UNSOLICITED EMAILS
All Referrers and Referred Borrowers are required to act ethically and in accordance with all applicable laws and regulations.

Referrers are limited to referring their own friends, family members, and direct acquaintances that they believe may be eligible for a Brazos loan.

You must only email friends, family members and direct contacts who have consented to receive an email about the Program and the Eligible Loans. 

You may share your Unique Referral Link with your contacts via social media platforms as long as the social media account is your personal account and you have a family, friend, or direct acquaintance relationship with anyone who may see your social media post.

This program is not intended for broad direct to consumer marketing.   Referral links must be shared personally, not through bulk email, automated tools, or third-party services except a otherwise indicated. Public advertising or buying search terms using Brazos’ name or products is prohibited..  Referred Borrowers must be able to personally identify you as their Referrer. Any misuse—such as spamming, impersonating Brazos, or violating Program rules—may result in immediate termination of your referral privileges.

Please review our borrower eligibility requirements on studentloans.com. Brazos reserves the right to disqualify anyone from this Program at any time. Anyone who violates these Referral Program Terms and Conditions is ineligible for payment of any bonus.

If you participate in the Program, you agree not to solicit applications for any type of Brazos loan. You agree not to compensate, or accept any compensation from, Referred Borrowers or anyone whom you refer to Brazos through the Program.  You may not collect any information from your contacts or assist with filling out a Brazos loan application.

Brazos may at any time, in its sole discretion, terminate the referral Program as to an individual Referrer and deactivate the Referrer’s Unique Referral Link. Unless Brazos deems Referrer to be in violation of law or the conditions provided herein, Brazos will provide one day notice of termination and Referrer shall be paid a Referral Bonus for any application(s) that was started prior to termination and is ultimately funded per the terms set forth above. The Referred Borrower will also be paid the Welcome Bonus under such circumstances.

INDEPENDENT CONTRACTOR
Your participation in the Program is solely as an independent contractor. Neither you nor Brazos intends to establish an employment relationship, and you are not entitled to any benefits. You are neither an agent nor representative of Brazos and you do not hold an express or implied right or authority of any kind to assume or create any obligation or responsibility on behalf of or in the name of Brazos.

CHANGES TO THE PROGRAM
Brazos reserves the right to change or eliminate the Program at any time or to change these Terms and Conditions at any time in its sole discretion. Brazos will use reasonable effort to notify the Referrer of the applicable changes. If the Program is cancelled, an application(s) that was started prior to cancellation and is ultimately funded per the terms set forth above may earn the Cash Reward(s), at the sole and absolute discretion of Brazos. If Brazos changes the amount of The Cash Reward(s) at any time, the new bonus amount will apply to new applications received after the effective date of the change. All participants, to include Referrers and Referred borrowers, acknowledge and agree that any disputes relating to the Program or any bonuses will be decided by Brazos in its sole and absolute discretion and that any such decisions shall be final and binding on all participants.

This Program replaces all earlier versions of the Program.
