Participants (“Referrers”) in the Brazos Education Lending Corporation (“Brazos”) Referral Program (“Program”) are subject to Brazos’ Terms and Conditions and Privacy Policy (both available on our website studentloans.com), as well as these additional “Referral Program Terms and Conditions”. By participating in the Program, each participant agrees that he/she has read and agrees to be bound by the Terms of Use, Privacy Policy, and these Referral Program Terms and Conditions.
Program Eligibility
You are not required to have a loan or account with Brazos in order to be eligible to refer friends to Brazos under the Program. The Program is only open to individuals who are a U.S. citizen, a permanent resident, or a resident alien with a valid U.S. Social Security Number residing in the United States. Participants also must be the age of majority in their state of residence to participate.
Referrers will not receive credit for referring themselves, including for a refinance of their existing Brazos loans, or submitting an application via their own unique referral link.
Employees of Eligible Schools, such as school financial aid officers, are not eligible to participate in the Program.
The Referral Bonus
The Program supports referrals to Brazos Loans only, and no payments will be made for referrals to any other loans or products or for any other reason. The referral bonus will be in an amount as advertised at the time you accept your referral link to participate in the Program. The referral bonus may not be the same amount for different loan products or at different points in time. The referral bonus will be paid after the first disbursement on any Brazos Loan that is not canceled within the applicable cancellation period as per the terms of the loan program.
To receive credit for a referral under the Program, eligible Referrers must provide a valid email address above to be provided a unique referral link. Referrers can then send the link to the people whom they intend to refer to the Program. In order for the Referrer to receive credit, each referred borrower must use their Referrer’s unique link to visit the studentloans.com website, and then click “Apply Here” on the studentloans.com website, complete their application, become approved, and proceed all the way through the first disbursement of the Brazos Loan. Bonuses will only be awarded after the Brazos Loan proceeds are disbursed successfully and any applicable loan cancellation period has elapsed.
There will be only one payment to a Referrer per unique Borrower's disbursed Brazos Loan. For a Student Loan and Brazos Parent Loan, payment will only be made for the first disbursement of a loan for a specific borrower in an academic year. If two or more individuals refer the same friend, then referral credit will be given based on which link the friend used to apply for a loan through Brazos’ website.
Although only one referral will be awarded per referred borrower, Referrers may earn more than one referral bonus by referring multiple borrowers. A Referrer will not earn a referral bonus if their referred borrower does not use the Referrer’s unique referral link when applying for their Brazos Loan. Due to privacy considerations, Brazos will not provide you the status of a referred borrower’s application, whether or not they have applied, or the names of the referred borrowers for whom you are being paid. All bonuses will be paid via check in accordance with Brazos’ standard accounts payable process after the applicable loan cancellation period has elapsed.
Once a Referrer qualifies for a payment, Brazos will contact the Referrer via email at the email address that was provided when obtaining the referral code (or an updated email address if subsequently provided) and will request a valid full name and address for delivery of the check for the Referral Bonus. The email will come from customerrelations@brazos.us.com. If a Referrer fails to reply with a valid full name and mailing address within sixty (60) days from the date of the first email requesting the same, the bonus payment is forfeited. Referrers are responsible for keeping Brazos apprised of any email or address change by contacting Brazos at customerrelations@brazos.us.com.
Rewards are not eligible if the borrower arrived through one of Brazos’ third-party lead-generation websites or business partner’s links or landing pages.
All federal, state and local taxes and duties are the sole responsibility of the Referrer. Payments may not be transferred. Any bonus due that would cause the cumulative bonuses paid to a Referrer in any calendar year to exceed $599 may not be paid unless the Referrer completes and returns to Brazos a United States, Department of Treasury, Internal Revenue Service Form W-9 (see https://www.irs.gov/pub/irs-pdf/fw9.pdf). A 1099 will be issued to a Referrer if the cumulative bonuses paid exceed $599 in any calendar year.
No Solicitation
All participants are required to act ethically and in accordance with all applicable laws and regulations. Referrers are limited to referring their own friends, family members, and direct acquaintances that they believe may be eligible for a Brazos Loan. This program is not intended for broad direct to consumer marketing. Please review our borrower eligibility requirements on studentloans.com. Brazos reserves the right to disqualify anyone from this Program at any time. Anyone who violates these Referral Program Terms and Conditions is ineligible for payment of any bonus.
If you participate in the Program, you agree not to solicit applications for any type of Brazos Loan. You agree not to compensate, or accept any compensation from, borrowers whom you refer to Brazos through the Program. You further agree that your activities will be limited to informing your direct contacts about Brazos’ Loans so that they may independently decide whether or not to apply for a Brazos Loan. You may not collect any information from your contacts or assist with filling out a Brazos loan application.
Use only truthful, non-misleading statements that accurately reflect Brazos and its Program when sending a referral message.
You must comply with all applicable laws and regulations, including anti-spam laws. Any distribution of a Program link must be done in a personal manner and sent to your own friends, family members and direct acquaintances that you believe may be interested in and are eligible for a Brazos Loan. Any referred borrower must be able to personally identify their Referrer. Further, you must have the referred borrower’s prior consent to send a Program link via email, text message or social media.
Bulk email distribution and any use of automated devices or third party services are prohibited. Referrers may not purchase internet search terms or publicly advertise Brazos’ products or name in any fashion.
Any distribution of a Program link that could constitute unsolicited commercial email or “spam,” any content which impersonates or implies an affiliation with or endorsement by Brazos or any actions which otherwise violate any conditions imposed by Brazos, as determined by Brazos in its sole discretion, are prohibited and will be grounds for immediate termination.
Brazos may at any time, in its sole discretion, terminate the referral program as to an individual Referrer and deactivate the Program Link. Unless Brazos deems Referrer to be in violation of law or the conditions provided herein, Brazos will provide one day notice of termination and Referrer shall be paid a bonus for any application(s) that was started prior to termination and is ultimately funded per the terms set forth above.
Independent Contractor
Your participation in the Program is solely as an independent contractor. Neither you nor Brazos intends to establish an employment relationship and you are not entitled to any benefits. You are neither an agent nor representative of Brazos and you do not hold an express or implied right or authority of any kind to assume or create any obligation or responsibility on behalf of or in the name of Brazos. If the cumulative referral and welcome bonuses paid to an individual in a one calendar year exceed $599 USD, then IRS form W-9 may be required to be completed prior to any payments. Any payments that are not claimed within 180 days of the date the funds have been made available, including failure to provide required tax information, are subject to forfeit.
Changes to the Program
Brazos reserves the right to change or eliminate the Program at any time or to change these Terms and Conditions at any time in its sole discretion. Brazos will use reasonable effort to notify the Referrer of the applicable changes. If the Program is cancelled, then an application(s) that was started prior to cancellation and is ultimately funded per the terms set forth above may earn the referral bonus, at the sole and absolute discretion of Brazos, and any unearned or unclaimed referral rewards will be forfeited at that time. If Brazos changes the amount of the reward at any time, any pending referrals will receive the new reward established by Brazos. All participants acknowledge and agree that any disputes relating to the Program or any rewards will be decided by Brazos in its sole and absolute discretion and that any such decisions shall be final and binding on all participants.
This Program replaces all earlier versions of the Program.
